A class action complaint has been filed against Samsung Electronics America, Inc. and Samsung Electronics Co. relating to Samsung HL-R, HL-S and certain other Samsung rear projection televisions. The suit is titled "McCalley v. Samsung, et. al." and is pending before the Honorable Joseph A. Greenaway, Jr., in the United States District Court, District of New Jersey. The lawsuit alleges that these Samsung televisions possess an inherent and latent defect in a component known as the Light Tunnel. This defect causes a video anomaly that consumers have come to call "The Shadow," which appears as a darkened strip running down the side of the television's screen, and which ruins the picture quality of these very expensive televisions. The lawsuit alleges that Samsung has been unable or unwilling to permanently correct this problem, which often appears only after the one year warranty period has expired. As a result, consumers have been forced to spend more than $1,000.00 attempting to fix their Samsung Televisions, only to have the problem return again. The lawsuit seeks compensation for Samsung’s breaches of warranty and violation of applicable consumer fraud laws.
